Terms of Service (Service Agreement)

These Terms of Service ("Agreement") are concluded between BesiNet ("BesiNet", "Platform", "Company") and the natural/legal person ("User", "Member") using the website or mobile application.

• Platform: the BesiNet mobile application and the www.besinet.com.tr website.
• Service: the digital platform where livestock, farm, equipment, feed and transport listings are published, and where services such as user communication, herd management, veterinary appointments, live auctions and bidding are provided.
• Content: all text, images, listings, messages, videos and files created by the User.

• You must be at least 18 years old to become a member.
• There are two membership types: Individual and Business.
• Business accounts become active after the Tax Certificate and required documents are approved.
• Identity verification via mobile phone number with OTP (SMS verification code) is mandatory.
• A user may only open an account in their own name. Accounts opened on behalf of third parties are closed.

3.1 Listings

When posting a listing, the User is obliged to:

• Provide real, accurate and up-to-date information,
• Not publish deceptive, misleading or illegal listings,
• Provide official documents such as health certificates and TÜRKVET approval,
• Not publish content contrary to animal welfare.

3.2 Payments and Subscription

Paid features (live auction, showcase, featuring, business package) are used through purchases. Payments are made via third-party payment providers such as İyzico / PayTR / Stripe. BesiNet does not store your card details.

You may cancel your subscription at any time. Although there is no automatic refund obligation for unused periods, consumer rights are reserved.

3.3 Auction Rules

• You are obliged to review the terms of use and auction information before entering an auction.
• A placed bid is binding; the winning bidder is obliged to complete payment and delivery.
• Accounts placing fake bids are terminated; legal proceedings may be initiated.

3.4 Messaging and Comments

In messages between users:

• Messages containing profanity, insults or threats are prohibited.
• Requesting personal data and attempted fraud are prohibited.
• Offering illegal services or products is prohibited.

The following behaviors are strictly prohibited and, if detected, the account will be closed indefinitely:

• Posting illegal, stolen or fake animal/goods listings
• Sharing content involving animal abuse or mistreatment
• Using fake identity or business information
• Sharing other users' contact information without their permission
• Using software/bots that threaten platform security
• Using tools that automatically post listings/requests (scraping)
• Sending advertising, spam or unauthorized commercial messages

• The BesiNet name, logo, designs, software and content belong to BesiNet.
• Content uploaded by the User (listings, photos) belongs to the User; however, the User is deemed to have granted BesiNet a non-exclusive license so that this content can be published on the platform.
• Copying, reproducing, distributing or reverse engineering is prohibited.

• BesiNet is an intermediary platform; it is not a party to the sales contract between users.
• The accuracy of listing content is the responsibility of the listing owner.
• BesiNet may mediate in disputes between users but does not guarantee an outcome.
• BesiNet cannot be held responsible for temporary technical outages or problems in third-party services (SMS, payment, maps).
• BesiNet accepts no liability regarding animal health, transport accidents, delivery delays, payment fraud, etc., without prejudice to the relevant legal regulations.

BesiNet reserves the right to temporarily or permanently suspend/delete an account in the following cases:

• Violation of this Agreement
• Intense complaints from other users
• Request of legal authorities
• Inactivity longer than 6 months (with notification)

The User always has the right to delete their account via the app or through the support e-mail address.

User data is processed under a separate document, the KVKK Privacy Policy. Acceptance of this Agreement means that the Privacy Policy is also accepted.

BesiNet may unilaterally amend this Agreement. Amendments enter into force from the moment they are published on the platform. By continuing to use the service after the changes, the User is deemed to have accepted the new terms.

This Agreement is governed by the laws of the Republic of Türkiye. Istanbul (Central) Courts and Enforcement Offices are competent for the resolution of disputes. Consumers reserve the right to apply to the Consumer Arbitration Committee in their place of residence.
